Magnum is fighting the lawsuit, but Hans is claiming damages of around £100,000.” “I am a member of the Magnum family and I own a good deal of their pictures. I’m very aware that the photos are available both on the Internet and in print. There were many requests to get the photos available, but unfortunately I haven’t done that. I have put a stop to that. I am very aware that the photos are in the public domain. A case has been pending in France against Magnum for the copyright infringement but we are currently facing a lawsuit in England over the images. In England there is a copyright statute, the ‘Common Law’, that protects works for a hundred years, but a new statute protecting copyrights lasts seven years. However, the court in the UK ruled that the ‘Common Law’ does not cover copyright as it had not been decided by law. For the moment, it’s in limbo.
